Eligibility for International Trademark Registration
Applicant must be a national, domiciled, or have a business in a member country of the Madrid Protocol.
A basic national or regional trademark application (or registration) must exist before applying for international protection.
Entities or individuals registered in India can apply through the Indian Trademark Office as the ‘Office of Origin.’

Process of International Trademark Registration
Step 1: File a national trademark application in your home country (e.g., India).
Step 2: Submit an international application (Form MM2) through the Indian Trademark Office to WIPO.
Step 3: WIPO examines the application for compliance and issues an International Registration Number.
Step 4: WIPO forwards the application to each designated country’s trademark office.
Step 5: Each national office conducts its own examination and either grants or refuses protection.
Step 6: Once accepted, the trademark is protected in all approved countries for 10 years, renewable indefinitely.
